Are there LLC types I can’t open without an SSN?
No. You can form a single-member or multi-member LLC in Texas without an SSN, using an ITIN or a passport. The one thing that involves extra IRS paperwork is choosing a special tax structure like an S-Corp election — but the LLC registration itself doesn’t depend on having a Social Security number.
Can my LLC hire employees if I don’t have an SSN?
Yes. Your LLC hires under its own EIN, not under your personal number. Each person you hire needs their own valid number or work authorization, but you, as the owner, don’t need an SSN for your LLC to run payroll.
Does opening an LLC affect my tourist visa?
Forming an LLC is a legal registration, not an act of employment by itself. Actively operating the business, however, can have implications depending on your immigration status. We recommend reviewing your case with an immigration attorney before operating — we handle the legal and tax side of the registration.
Which passports work? Mexican, Salvadoran, Venezuelan…?
A valid passport from your country of origin works as identification for the state registration — Mexican, Salvadoran, Venezuelan, Honduran, Guatemalan, Colombian or any other nationality. The IRS also accepts it as identification when filing your EIN without an SSN.
Does an LLC help my immigration case?
Owning an LLC does not grant immigration status or benefits by itself. It does show formal economic activity and a tax history — something that, guided by your immigration attorney, can count as evidence of stability in certain processes.
What if I get a Social Security number later?
You update your information with the IRS and your bank without losing your LLC or forming it again. The LLC stays yours — only the tax identification number linked to you as the owner changes.
Do I have to file the FinCEN BOI report?
If your LLC is formed in Texas, today no. The BOI (Beneficial Ownership Information) report came with the Corporate Transparency Act, and in 2024 it applied to almost every LLC — but in March 2025 FinCEN changed the rule: now only companies formed outside the United States that register to operate here must file it. Companies formed under a state’s law — like your Texas LLC — are exempt, and don’t have to update or correct a report they filed before. Since this area has shifted several times in the courts and at Treasury, we review it with you when opening your LLC and let you know if it moves again.
